1. OBJECTIVE

The purpose of this policy is to establish guidelines for the processing of personal data collected, stored, used, transmitted, and/or transferred by ARKEBIM SAS, in compliance with the provisions of Law 1581 of 2012, Decree 1377 of 2013, and other applicable regulations.

2. SCOPE

It applies to all personal data obtained in the course of commercial, contractual, employment, and/or other activities from clients, suppliers, employees, contractors, and other data subjects.

 

3. DEFINITIONS

  • PERSONAL DATA: any information linked to or that can be associated with one or more specific or determinable natural persons.
  • SENSITIVE DATA: those that affect the privacy of the owner or whose misuse may generate discrimination
  • TREATMENT: any operation on personal data, such as collection, storage, use, circulation or deletion.
  • DATA CONTROLLER: natural or legal person who processes data on behalf of the controller
  • DATA CONTROLLER: natural or legal person who decides on the database and/or processing.


4. PRINCIPLES FOR TREATMENT

The processing of personal data will be governed by the principles of legality, purpose, freedom, truthfulness, transparency, restricted access and circulation, security, and confidentiality.

5. RIGHTS OF THE HOLDERS

Personal data subjects have the right to:

  • Know, update and rectify your data.
  • Request proof of the authorization granted for the treatment.
  • Be informed about how your data has been used.
  • File complaints with the Superintendency of Industry and Commerce (SIC).
  • Revoke authorization and/or request deletion of data.
  • Access your personal data that has been processed free of charge.

6. AUTHORIZATION OF THE HOLDER

ARKEBIM SAS will request prior, express, and informed authorization from the data subject, except in cases provided for by law, for the processing of personal data.

7. PURPOSES OF THE PROCESSING

The personal data collected will be used for:

  • Administrative, commercial and financial management.
  • Execution of contracts with employees, customers and suppliers.
  • Compliance with legal, tax and accounting obligations.
  • Sending information related to the company's products, services and activities.
  • Evaluation of quality of services and customer service.
  • Staff selection, hiring, administration, and dismissal processes.

8. SECURITY MEASURES

ARKEBIM SAS will implement reasonable technical, human, and administrative measures to protect personal information against loss, unauthorized access, misuse, or alteration.
